Commencing the Divorce Process
An Ohio divorce begins with the filing of a complaint by the plaintiff (the party who initiates the divorce). The complaint must:
- Allege that the plaintiff has resided in Ohio for at least six months prior to the filing
- Specify the date and place of marriage and the birth dates of any minor children
- Indicate an allegation of the presence of at least one of the fault grounds for divorce
- Contain a demand for relief being requested from the court
A person filing for divorce in Ohio must have been a state resident for at least six months prior to the filing of the divorce complaint.
