Once a divorce complaint is served upon the other party, an answer and counterclaim follows. The next stage involves the issuance of temporary orders, usually dealing with child custody, child support, child visitation, spousal support or alimony, and the preservation of the marital property state.

Then, the divorce attorneys will conduct discovery. This allows all assets, liabilities and income to be identified and valued, by using interrogatories, request to produce documents, depositions and subpoenas. Once this process is completed, the parties will either enter into a divorce settlement or the unresolved issues will be set for trial for a final determination by the marital law court.

What happens in a divorce in Kentucky?

A divorce in Kentucky is called a dissolution, whether it is contested or uncontested. It starts with the filing of a document called a Petition for Dissolution. Kentucky is a no fault state, so no grounds need be asserted. Only one spouse need believe that the marriage is irretrievably broken and that there is no reasonable expectation of reconciliation.

After the petition is served upon the spouse, a Response is filed. The case then moves into the stage of the issuance of temporary orders, usually dealing with child support, child custody, child visitation, spousal support or maintenance, and the preservation of the marital property state.
