Can You Challenge the Result of Your Trial?
Our criminal justice system is good, but not perfect. Sometimes juries are misled or confused about the facts. There are times when Judges make bad calls or apply the law wrongly in your case. The final outcome of your case may not always be “just” or right. It is even possible that what occurred at trial is not at all an accurate reflection of what really occurred.
A guilty finding or unjust sentence at the trial court does not need to be the end of your case. You do have options.
What Is An Appeal?
An appeal is when you ask a higher court to review your case to determine if any errors occurred leading up to or at your trial. An appeal is not a new trial or another bite at the apple. But an appeal does allow you the opportunity to challenge the rulings made and evidence presented at the trial level. If successful, you could be granted a new trial or even better, have your conviction completely overturned.
Appeals are document and time intensive. The appeal attorney must review the entire trial transcript and record to determine what errors occurred and how those errors can be challenged. Appeals are also time sensitive. Notice of appeal from what occurred at the trial court must be fined in timely manner, in most jurisdictions that is within 30 days. If not filed, you may lose the right to appeal what happened.
