How is child support calculated?.
Child support guidelines are mandated by state law. These guidelines are utilized in the calculation for how child support is to be determined. Parents owe the legal duty of child support to support their children until they turn 18, unless the child has not yet to graduate from high school, or reach the age of 19. In certain circumstances, dealing with extraordinary medical issues, the duty of child support may continue indefinitely for a disabled child.
Generally, child support is calculated by determining the combined gross income of the parties, and then allocating the child support obligation. Sometimes, there are factors that might cause a court to deviate upward or downward from the child support guidelines. These factors often focus on the special medical needs of the child, the parenting time allocation, expenses of sports or activities, and private school tuition. The evidence supporting a deviation for a child support order must be presented to the court in an organized, appropriate manner.
