What is collaborative family law?
Collaborative family law is an alternative to divorce litigation. This process takes an entirely different approach to settlement than does the traditional negotiation. Although both parties have attorneys, this is not an adversarial process associated with litigation. The goal of collaborative law is cooperation without the threat of going to court.
The core principle of collaborative family law is the commitment to resolving all issues without use of the court model or without reference to it. An agreement committing to the collaborative concept and agreeing not to file for divorce is signed by the parties and their attorneys. Creative options are used to resolve issues, including implementing possibilities that might not be available under the court model. The parties control the process, and as a result, they are more likely to feel satisfied with the outcome.
Because collaborative family law is based upon negotiation, as opposed to traditional litigation, if an agreement cannot be reached, both attorneys must withdraw from the case and the parties can proceed to litigation with new counsel.
