Parent Relocation
The most complex and combative issues in custody cases arises when one parent seeks to relocate to another jurisdiction with the children. Our family law lawyers often represent parents on both sides of these relocation issues.
Relocation to another state can be stressful for a sound marriage. The effects of divorce on children are even worse when relocation is by one of the divorced parents. According to divorce statistics, relocation cases usually come about when a divorced parent gets a new employment opportunity or remarries. Sometimes relocation happens when a custodial parent wants to go back home where extended family is located to have a network of support. Either of these scenarios has a critical influence the custody of a child. The separation caused by the geographical distance when one parent moves is just part of the dilemma for the family court to consider. The family court will also consider the issue of child support; physical custody; and the effect of the parental rights of each party to the custody case.
If the other parent objects to the relocation, the matter will be litigated and the family law court will determine whether it is in the child’s best interest for that parent to be permitted to relocate with the child. A number of factors are considered by the family law court when making this decision. These factors include: the reason for the move; the distance of the move: the age of the child; the relationship of each parent with the child; which parent has been the custodial parent; the proximity to extended family; and, the proposed community.
Of greatest concern to the family court is whether a parent’s proposed relocation is in good faith or is to be used for parental alienation to interfere with the other parent’s ability to have meaningful time with the child.
