Domestic Violence Is a Serious Criminal Charge
The criminal charge of domestic violence is different from other violent offense and can carry more long term penalties and effects. Domestic violence refers to physical or attempted physical assault on a person who is your spouse, parent of your child, child, or person who resides with you in an intimate relationship. These offenses are taken very serious by prosecuting attorneys. If your charged with Domestic Violence, know that there are many advocacy groups out there working against you. These groups are usually focused at protecting women, so if you’re a man charged with domestic violence, be aware of the groups pushing for your prosecution.
Domestic violence is an enhanceable offense. This means that if conviction, any future charge for domestic violence will be a higher level criminal charge, such as a felony. A domestic violence conviction can also lead to your loss of a right to own or possess a firearm, use a gun for hunting, coach your children’s athletic teams, and it can mark you as a violent offender for life. Domestic violence restraining orders and protective orders can also be issued. These orders can keep you out of your own home or from seeing your family while the case is going on. Know Your Rights
There are defenses to a criminal charge of domestic violence. Just because your charged with the crime, does not mean you’ll be convicted. Self defense and batter women syndrome are just some of the legal defenses available to you. We see a lot of domestic violence charges filed based upon ill motivations by the alleged victim. We have worked with clients charged with domestic violence because their spouse was attempting to gain advantage in a custody or divorce case. We have represented clients with false charges of domestic violence because the alleged victim wanted to get back at them for a break up, cheating, or because they didn’t get their way.
