Prenuptial Agreement
What is a prenuptial agreement?
This document, also called a premarital agreement, must be in writing and signed by both parties, is used to address issues related to either the death of one of the spouses or if a divorce occurs. The parties may also include how they will handle their assets and finances during the marriage. Usually, the divorce provisions deal the division of property, debts and spousal support. Child custody and child support issues may not be determined in a prenuptial agreement. A prenuptial agreement is not a marriage contract.
Do you need a prenuptial agreement?
The answer depends on your situation. These agreements are not only for famous or rich people. Given the divorce rate, doing so may be a good idea. This is especially true if one or of both parties have a prior marriage. Many times, one or both parties have children from the prior marriage. Prenuptial agreements protect their children’s financial interests in the event of their death. Other times, the parties want to protect the significant separate assets they are bringing into the new marriage. Prenuptial agreements are appropriate when there is a large disparity in the ages or the financial situation of the parties.
Each party to the prenuptial agreement must be represented by counsel. Negotiating the terms of a prenuptial agreement so that it is fair to both parties, yet withstand scrutiny in the courts requires a skilled and highly experienced lawyer.
