Spousal Support
What is spousal support?
Sometimes called, alimony or maintenance, spousal support is paid from one spouse to the other, even though the marriage is being terminated by way of a divorce or dissolution. This issue arises when spouses are getting a divorce or dissolution after a lengthy marriage, or, when there is a substantial disproportion of the incomes of the spouses. The marital law requires the courts to consider a number of factors when determining whether to order spousal support, and if so, how much and for how long? Some of these factors include:
- Ages of the spouses
- Length of the marriage
- Income of the spouses
- Retirement benefits of the spouses
- Relative earning capacities of each spouse
- The standard of living during the course of the marriage
- Retirement benefits of the spouses
- The relative health of the spouses
- Tax consequences
- The relative educational levels of each spouse
- The contribution of each spouse to the education or training of the other spouse
Spousal support is within the discretion of the court and is sometimes unpredictable. Unlike child support, there is no mandated formula either in Ohio or Kentucky. This means that a wide range of potential outcomes in any spousal support dispute is possible.
